Terms of Service

Agreement

By using Ekly, you agree to these terms. Ekly is operated by Baaspani Pty Ltd, registered in Australia. If you do not agree to these terms, do not use the service.

These terms apply to all users including guests who use the service without an account.

The service

Ekly provides URL shortening, link analytics, QR code generation, and related tools. We reserve the right to add, modify, or remove features at any time.

We aim to provide a reliable service but do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible.

Your account

• You must provide accurate information when creating an account
• You are responsible for keeping your password secure
• You are responsible for all activity that occurs under your account
• You must be at least 16 years old to create an account
• One person may not create multiple accounts to circumvent limits
• You must notify us immediately of any unauthorized access to your account

Acceptable use

You agree to use Ekly only for lawful purposes. You must not use the service to:

• Shorten links that point to malware, phishing sites, or illegal content
• Distribute spam or unsolicited messages using Ekly links
• Circumvent or attempt to circumvent our rate limits or security measures
• Impersonate any person or organization
• Violate any applicable law or regulation

Content and links

You retain ownership of the URLs and content you create through Ekly. By using the service, you grant us a limited license to store and process your URLs solely for the purpose of operating the service.

We do not endorse any content that short links point to. We are not responsible for the content of destination URLs. We reserve the right to disable any link that violates these terms.

Pricing and billing

Ekly currently offers a free tier. We may introduce paid plans in the future. If we do:

• We will give at least 30 days notice before charging existing free users
• Existing features on the free tier will not be removed without notice
• Pricing will be displayed clearly before you commit to any payment
• Refunds are handled on a case by case basis

Termination

You may delete your account at any time from your account settings. We may suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.

On termination, your links will be deactivated and your data will be deleted within 30 days per our data retention policy.

Limitation of liability

Ekly is provided as-is without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.

Our total liability to you for any claim arising from your use of Ekly shall not exceed the amount you paid us in the 12 months prior to the claim. For free tier users this is zero.

Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.

Changes to these terms

We will notify you by email of material changes to these terms at least 14 days before they take effect. Continued use of Ekly after that date constitutes acceptance of the updated terms.
